{"id":339804,"date":"2015-07-27T13:37:04","date_gmt":"2015-07-27T11:37:04","guid":{"rendered":"https:\/\/courtwatch.pl\/?page_id=9639"},"modified":"2015-07-27T13:37:04","modified_gmt":"2015-07-27T11:37:04","slug":"tasty-high-orchard","status":"publish","type":"page","link":"https:\/\/courtwatch.pl\/en\/projects\/projects-implemented\/tasty-high-orchard\/","title":{"rendered":"Tasty, High Court!"},"content":{"rendered":"<p>&quot;Tasty High Court!&quot; is the title of a research project conducted by the Court Watch Poland Foundation in cooperation with the Department of Population Research at the Institute of Sociology of the Jagiellonian University.<\/p>\n<p>It seeks to draw public attention, in particular to the judicial community and the administration of the courts, on the impact of non-legal factors &#8211; including the working conditions of judges &#8211; on the decision-making process and, consequently, on case-law. In our research we refer to the theory of legal realism, which assumes that the judge is not only the &quot;mouth of the law&quot; &#8211; he does not rule mechanically on the basis of legislation &#8211; but also remains under the influence of external conditions.<\/p>\n<p>The project was inspired by a 2010 Israeli study by Shai Danziger, Jonathan Levav and Lior Avnaim-Pessa, which found that blood glucose levels had an impact on judges&#39; decision-making. It has been proven that when the judge had the opportunity to take a break and eat a meal before sentencing, in 65% of cases he ruled more favourably for convicted, then gradually decreased over time until it reached 0%.<\/p>\n<p>As part of the project &quot;Tasty, High Court!&quot; we will conduct a thorough analysis of scientific publications on the impact of external conditions on the decision-making process.
