One of the fundamental changes we are seeing is the unprec<strong>edented reduction in the transparency of proceeding<\/strong>s. In courts across Poland, it is not allowed to attend meetings and announcements of public judgments. Such practices are incompatible with Article 81(1) of the<strong> Treaty. Article 45 of the Polish C<\/strong>onstitution and, in the extreme case, threatens the defectiveness of thousands of proceedings and judgments.<\/p>\n\n\n\n<p>The direct motivation for the investigation was a letter to the presidents of the courts on 18 May 2020 by The Undersecretary of State at the Ministry of Justice, Dr. Anna Dalkowska, which reads: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Access to court buildings of persons other than those called upon to attend or otherwise necessary shall be prohibited.  It is recommended that the presidents of the courts issue orders preventing or restricting the public&#39;s access to the courtrooms. <\/p><cite> Letter from the Ministry of Justice DNA-II.510.20.2020 <\/cite><\/blockquote>\n\n\n\n<p>A team of researchers and volunteers of the Court Watch Poland Foundation analysed the orders governing access to courts in all ordinary, administrative and Supreme Courts (in total in 392 courts). In addition, the practice of exercising the right to a public trial has been tested in dozens of selected courts through the visit of an observer of the Foundation. <\/p>\n\n\n\n<p><strong>The conference will take place online on the platform for webinars Getresponse.
